Terms and Conditions
Our Guarantee:
We promise to do everything in our power to deliver you a cake and or desserts that exceed your expectations. We will work with you on every level to make sure you are completely satisfied and happy with your cake / desserts. Please note that colors and design of the actual cake may vary from images that may have been provided. All pictures will be used as inspiration only.
Another artists’ work will not be copied.
Ordering:
B’Luxe Cake Studio requires all custom orders be placed 2-4 weeks before your event to secure your specified date. Orders placed 7 days or less before your event date, will incur a $100 rush order fee.
Payment:
Payment is due upfront in full for all orders under $300. Once a quote is accepted, an invoice will be sent. Payment is required within 48 hours. Orders over $300 require a Non-Refundable retainer fee of $100. The remaining balance must be paid 7 days before your event. The retainer fee will be applied to the balance due, and secures your event date. AfterPay is available for all orders. Additional & Extended payment terms are available upon request. Final payment must be paid 7 days before event. Production will not begin until balance or retainer fee is paid. In the event an invoice is sent and not paid within 48 hours, it will be canceled and a $5 fee will be added to send another invoice.
If your event is within 7 days or less of your request, payment is due in full within 48 hours, plus a $100 rush fee will be applied.
Order Changes:
Changes to your order such as, size, description, flavors, quantity etc. will be accepted 14 days prior to the event date. After this time, your order is final and changes will not be accepted. If changes increase the price of your order, payment is due at the time the change is made.
Refunds:
Cash, debit/ credit card refunds will not be given. If a refund is deemed necessary, it will be applied in the form of store credit, minus the retainer fee and monies used to order supplies. In the event your order did not meet your expectations, and you are requesting a refund, you must call the day of your event before the cake / dessert is cut / consumed and served so it can be returned and evaluated. Without proof that you are indeed unsatisfied with the product and will not be using it at your event, a refund (store credit) of any kind will not be given. Return of the product in its original form insures the rare case of “If we complain we’ll get it for free”
Cancellations / Date Changes:
Cancellations must be made 14 days before event date to receive store credit. Cancellations made within this time will receive store credit of what was paid minus the retainer fee and monies spent to buy supplies. Store credit must be used within 6 months of original event date. Cancellations made after the 14 day lockout date will forfeit the retainer fee and all monies spent, and will not receive store credit. Date changes are subject to B’Luxe Cake Studio availability. A date change is not guaranteed. In the event a new date is available, you the client will incur a non-refundable $100 change fee due immediately. Communication is key, if you are up front about any issues, we will do our best to accommodate you.
COVID-19
We understand that with COVID-19, things can change unexpectedly and may cause last minute event cancellations and reschedules. However, all retainers remain non-refundable. Please inform us as soon as possible if you need to cancel / reschedule. We will do our best to accommodate the change.
Other Important Info:
B’Luxe Cake Studio will photograph all cakes and desserts. We reserve the right to use any photographs for display or promotion without compensation to you. Our products and equipment may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.
Delivery/ Pick up
We strongly suggest delivery and setup be done by B’Luxe Cake Studio, however, you do have the option to pick up your order at your own risk. We are not responsible for any damages to your order once it leaves B’Luxe Cake Studio possession. If you the client or your designated party elect to pick up, you or your responsible party assume all liability and responsibility for the condition of the cake once it leaves B’Luxe Cake Studio possession. Once an item has been picked up by you or your designated party, and leaves our possession, it is considered accepted. Additional terms and conditions will require a signature at the time of delivery / pick up. Delivery fee is $50 for up to 10 miles then $3.00 per mile to and from provided address based off of google maps thereafter.
Delivery is only available Friday evenings after 7pm, Saturday and Sunday at the specified time listed on your order form. Weekday orders must be picked up the evening before the event between 6pm and 8pm only. it is expected that you the client or designated party be on time. We will not wait, change delivery locations or hold your order for any reason. In the event you or your designated party is late, there will be non-refundable $5.00 per min late fee to be paid before the order is released. In the event you the client or designated party are a No Show, you will forfeit all monies spent and a refund / store credit will not be given.
While we understand things happen and may be out of your control, any and all situations will be evaluated on a case by case basis.
The client is responsible for providing an appropriate size, level, and stable table with a cool and safe environment for the Cake / desserts ordered. B’Luxe Cake Studio is not responsible for damage resulting from tables that are not level, weak or too small, or placed in a warm area. Please keep in mind that there can be rain, wind, temperature, pets, bugs or other situations that can harm or cause damage to your cake / desserts. We are not responsible for any damage, for any reason to your cake / dessert after it leaves our possession.
In the case of an unavoidable occurrence, such as a car accident, poor road conditions bad weather during delivery etc., B’Luxe Cake Studio cannot be held liable for more than the cost of the order described on the order form. If the cake / dessert is not delivered or irreparable, store credit will be given for the cost total order minus the retainer fee.
The client will provide clear driving directions to the delivery location and inform B’Luxe Cake Studio of any road hazards and /or obstacles that may hinder the delivery and quality of the finished cake(s). Road hazards / obstacles include but not limited to potholes, road construction, unseen road conditions etc.
